Terms and Conditions

1. DEFINITIONS

In this document the following words shall have the following meanings:

  • "Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;
  • "Customer" means any person or company who purchases Goods from the Seller;
  • "Goods" refer to articles that are purchased by the Customer from the Seller.
  • "Seller" refers to Pint Sized People Ltd of Registered Office Address Avondale Business Centre, Woodland Way, Kingswod, Bristol, BS15 1AW
  • "List Price" infers to the list of prices of the different goods maintained by the Seller and shall be amended from time to time.
  • "Terms and Conditions" means the terms and conditions of the sale as has been set out in this document and may include special terms and conditions agreed in writing by the Seller.

2. GENERAL

  • Terms and conditions in this document shall apply to all contracts for the sale of Goods by the Seller to the Customer.
  • The terms in this document shall prevail over any other documentation or communication from the Customer.
  • The acceptance of delivery of the goods shall be undoubtedly treated as conclusive evidence of the Customer’s acceptance of these terms and conditions.
  • Any changes or variation to these Terms and Conditions shall be void and inapplicable; unless agreed in writing by the Seller.
  • These Terms and Conditions shall not affect the Customer’s statutory rights as a consumer.
  • The Customer shall be deemed to have accepted these Terms and Conditions on payment.

3. PRICE AND PAYMENT

  • The price of the goods for sale are shown on the Seller's website at www.pintsizedpeople.co.uk
  • Goods maybe offered for sale on other avenues and may be charged at different prices.
  • The price shown is VAT inclusive at the current rate for EU Members Countries.
  • The price shown is VAT exclusive for Non EU Member countries.
  • Delivery charges are extra as applicable and full information is shown on the delivery information page.
  • Dispatch of goods will be made once cleared payment for the purchase has been received.  Goods will be dispatched as per the delivery information page and the delivery method selected.

4. DELIVERY

  • Delivery of purchased Goods will be sent to the address supplied by the Customer at time of checkout.
  • All purchased goods will be dispatched within one working day from date of payment.
  • If Goods are not in stock, the seller will inform the Customer within 72 hours.
  • In the event of inability to deliver on time due to unavoidable circumstances, the Seller shall not be liable for any damages arising directly or indirectly.
  • Upon delivery ownership and risks of the Goods transfer from the Seller to the Customer.
  • The date of delivery specified by the Seller is an estimate only. Time for delivery shall not be of the essence the Terms and Conditions and the Seller shall not be liable for any loss, costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the Goods.


5. WARRANTY

  • The Seller warrants that the delivered goods correspond in totality to the description given by the Seller to the Customer.
  • The Seller warrantees and represents that the goods are as described.
  • The Seller specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement of Goods offered for sale.
  • Customers should satisfy themselves that any item choice made, is suitable for their intended purpose or use including manufactuer's age recommendations.  

6. CANCELLATION AND RETURNS

  • The Customer shall inspect the goods immediately upon receipt and shall notify the seller within 7 days of delivery if the goods are damaged or do not comply with the Goods offered for sale.
  • Claims of defective or damaged goods shall be returned by the Customer to the Seller and the Customer shall be entitled to a replacement or a full refund plus any return postal charges if the goods are in fact defective.
  • Goods to be returned must clearly state the order number and name and address of Customer.
  • If returned goods are found to be damaged due to the buyer's fault the buyer will be liable for the cost of remedying such damage.
  • For change of mind goods - The Customer has a right to cancel goods received and receive a refund by informing the seller in writing or by email within 14 working days of receipt of the goods. Goods must be returned at the Customer’s expense  and should be adequately insured.  The Buyer shall receive a refund of all monies paid for the goods excluding return postal charges within 30 days of cancellation.
  • These Terms and Conditions do not affect a Customers Satutory Rights.

7. GUARANTEES

  • In addition to the Consumer's Statutory Rights, the Seller guarantees all Goods against faulty workmanship and materials inline with the Manufactuer’s warranty from the date of delivery.

8. LIMITATION OF LIABILITY

  • Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury, however the Seller shall not be liable for any direct loss or damage suffered by the Customer howsoever caused, as a result of any negligence, breach of contract or otherwise in excess of the price of the goods.
  • The Seller shall not be liable under any circumstances to the Customer or any third party for any indirect or consequential loss of profit, consequential or other economic loss suffered by the Customer howsoever caused, as a result of any negligence, breach of contract, misrepresentation or otherwise.

9. FORCE MAJEURE

  • Neither Seller nor Customer shall be made liable for any delay or failure to perform any of its obligations; if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire  and the party shall be entitled to a reasonable extension of its obligations.

10. SEVERANCE

  • If any term or provision of these Terms and Conditions listed in this document is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect.

11. RELATIONSHIP OF PARTIES

  • Nothing contained in these Terms and Conditions shall be construed as establishing or implying any partnership or joint venture between the parties and nothing in these Terms and Conditions shall be deemed to construe either of the parties as the agent of the other.

12. WAIVER

  • The failure by either party to enforce at any time or for any period any one or more of the Terms and Conditions herein shall not be a waiver of them or of the right at any time subsequently to enforce all Terms and Conditions of this Agreement.

13. GOVERNING LAW AND JURISDICTION

These listed Terms and Conditions shall fall under the governance and construed in accordance with the law of the UNITED KINGDOM and the parties hereby submit to the exclusive jurisdiction of the BRITISH  courts.
